Child Support Enforcement
The Scott County Attorney’s Child Support Office processes thousands of child support cases. Through the Kentucky Cabinet for Health and Family Services, the Child Support Division offers a variety of services. Anyone who has custody of a child and needs help establishing paternity or child support, or collecting current or past-due child support payments may apply to receive child support services. Our office helps with locating non-custodial parents; establishing paternity, establishing child and medical support; collecting and enforcing established child support orders; and reviewing established orders for possible modification.
Under Kentucky law, both parents have an obligation to support their children, and both have a right to expect the other parent to assist with support. To begin the process of collecting support, either parent can visit the Kentucky Child Support Interactive website to apply for services. If paternity has not been established, our office will assist with that process.
Once paternity has been established, the Child Support Office will assist with the process of establishing a child support payment from the non-custodial parent. The monthly child support obligation is calculated based on child support guidelines under Kentucky law (KRS 403.212). A child support estimator is available on the KCSI website. Once the child support amount has been established by court order, it can only be modified under certain circumstances.
If the non-custodial parent does not pay child support as ordered, there are various administrative and judicial enforcement remedies available to our office, such as:
- Status Hearing
- Show Cause/Contempt Hearing
- Flagrant Nonsupport
- License Suspension
- State and Federal Tax Offset
- Bank Levy
Our staff and attorneys have a duty to provide child support services and to represent the best interests of the children. We do not represent either parent in court. There are times when a custodial parent does not agree with the course of action chosen for a case. That parent may choose to close his/her case with the office and pursue collection independently or through a private attorney. By law, the Child Support Office cannot address other issues that are often associated with establishing and/or enforcing a child support order, such as divorce, property settlements, termination of parental rights, visitation and custody agreements, establishing or modifying spousal support, or providing legal advice or counsel.
