In most cases, writing a bad check is a crime pursuant to KRS 514.040 (Theft by Deception). If you received a bad check, you may bring a copy of the check to our office during business hours or email it to Sonja.brent@scottky.gov. Our office will send a letter to the person who wrote the check giving them ten business days to make good payment. If the person does not respond to the letter, bring the original check to our office and we will initiate a criminal complaint for Theft by Deception. You will need to come into our office to sign the complaint. This applies primarily to checks that have been stamped by the bank stating nonsufficient funds (NSF) and checks written on closed accounts. Not all checks qualify for the bad check program. The statute of limitations is one (1) year for checks under $1,000 and is considered a misdemeanor. However, checks over $1,000 are felonies and do not have a statute of limitations.
